Proceedings


 

About Proceedings online services 

Proceedings in IPONZ’s case management facility have been structured so that each proceeding has its own case number and its own separate repository for documentation relevant to the proceeding.

When a new proceeding is filed the party filing the proceeding – the proceeding applicant -will be advised of its proceeding number. The office will communicate through the system to the IP owner or their agent to inform them a proceeding has been commenced. Both the proceeding applicant and the IP owner and their agent will have access to see the activities and documents on the proceeding case, though some individual documents may be confidential.

 

Search for a proceeding case

Where the proceeding is an opposition, the case status of the related case will show as Under Opposition.

You can use the advanced searching functions to search for cases that are under proceeding.

For example if you know the trade mark case that has been opposed, enter the trade mark number into the Case Number field. You can also find all trade marks that are currently under a proceeding, whether it be an opposition, revocation, or invalidity proceeding, by ticking the Under Proceedings Cases tickbox when searching.

On the search results section you can see whether the case is under a proceeding or not by look at the Under Proceeding column.

How to search for your own proceedings case?

In order to Search Proceeding cases you need to login to the system.

If you know the proceeding case number(s) -

You can search by Proceeding Applicant’s client reference number for the proceeding case –

You can search by the case status. This will enable you to find all proceedings of each type, by current status –

You can also search for the cases you are involved in which have proceedings against them by using the My Case Portfolio functionality, once you are logged into our system.

Use the advanced searching functionality to tick the Under Proceeding Cases tickbox.
