New status descriptions for Hearings Office Proceedings
The Intellectual Property Office of New Zealand (IPONZ) has introduced two new status descriptions for patents, trade marks and designs.
The new status descriptions make it easy to identify patents, trade marks or designs that are subject to an opposition, revocation or invalidity proceeding, by searching the online register or using the View IP History service. See www.iponz.govt.nz/online-services
The table below lists the updated status descriptions by division:
Division | Status number | Status description | Explanation of how an application gets to the nominated status |
Patent | 75 | Accepted/Under Proceeding | The patent application has been accepted and there is a possible opposition or an opposition lodged against this application. |
101 | Granted and Sealed/Under Proceeding | The patent is granted and sealed and an application for revocation has been lodged. | |
Trade Mark | 75 | Accepted/Under Proceeding | The trade mark application has been accepted and there is a possible opposition or an opposition lodged. |
101 | Registered/Under Proceeding
| The trade mark is registered and an application for revocation and/or application for declaration of invalidity of registration is lodged. | |
Design | 101 | Registered/Under Proceeding | The design is registered and an application for cancellation of registered design is lodged. |
Updated proceeding descriptions
In addition to the new status descriptions, the descriptions of the proceeding types have been updated. The following describes the new proceeding descriptions:
- When an Extension of Time to file a Notice of Opposition is granted by the Office the application will display ‘Possible Opposition’ and the status of the application will be updated to 75.
- All new patent and trade mark Revocation proceedings will now display as ‘Revocation’ instead of ‘Challenge’.
- All new trade mark Declaration of Invalidity will now display as ‘Invalidity’ instead of ‘Challenge’.
Current Revocation and Invalidity proceedings will remain as ‘Challenge’ until resolved.
