7. Amendments after acceptance

Request to amend the specification for Granted or Accepted Patents may be made at any time via IPONZ online systems.

The request must be accompanied by:

  • A clean copy of the proposed new specification.
  • An electronic marked up copy of the proposed amendments indicating where additions and/or deletions have been made to the specification.
  • A statement of the nature of the proposed amendment (correction, disclaimer or explanation);
  • Reasons for which the request is made.7
  • Fee payment.

The applicant must indicate with their application if the amendment has been directed by the court, or if there is any action or proceeding related to the patent application before the court.

Where an amendment after acceptance has been accepted, then the proposed amendments will be published in the next journal and will be subject to a two month opposition period.
