How to check for existing plant variety rights

It pays to check if your plant variety is original before you apply for a variety right or before you market your variety:

  • There is no point in applying for plant variety right registration if it is not original or may be seen as similar to a registered plant variety right;
  • Once the application has been validated by the Office, the applicant can take legal action against anyone trying to market an identical variety.

 

How can I check that my variety is new?

Start by searching the New Zealand Plant Variety Rights database of New Zealand Plant Variety Rights.
