Online searching of the trade marks register – proceedings

How do I know from the trade mark register search results whether something is under a proceeding?

The Under Proceeding column in the search results will identify whether the trade mark is under a proceeding or not.

Where the proceeding is an opposition, the case status will also show as Under Opposition.

 

You can use the Show/Hide column control to change what information is shown in your search results:

How do I search for trade marks that are under a proceeding?

Go to Search the Register > Trade Mark Search.

You can use the advanced searching functions to search for trade marks that are under proceeding.

If you know the trade mark case number that you’re involved in, enter it into the Case Number field -

How do I find all trade marks that are under a proceeding?

You can find all trade marks that are currently under a proceeding, whether it be an opposition, revocation, or invalidity proceeding, by ticking the Under Proceedings Cases tickbox.

How can I filter down my search?

By keeping the Under Proceeding Cases box ticked you can use any of the other advanced searching functions to narrow your search criteria.

For example:

  • You can find all trade marks containing a certain word and/or a certain image/logo that are under proceeding by using the using the Title search field.
  • You can find all trade marks owned by a particular applicant or owner by identifying that applicant or owner through the Applicant/Owner search functionality.
  • You can find all trade marks that are under examination status that have a proceeding against them. This will identify all trade marks where the trade mark examination team has issued a notice of intention to reject and the applicant has sought a hearing.
  • You can find all trade mark proceedings that have a particular contact name by using the Case Contact search functionality.

Viewing your search results

Your search results will display beneath the search criteria once you press Search.

You can use the Show/Hide column control to change what information is shown in your search results:

You can use the Send Result List to email yourself a copy of your search results. Enter your email address and the select either the Excel of PDF report.

The PDF report will give you a full summary of each IP in your search results. In the context of proceedings it is notable that the Linked Cases part of the PDF report will state the party that has lodged the proceeding.

 

Searching for your own proceedings

How do I find a proceeding case I’m involved in?

In order to Search Proceeding cases you need to login to the system.

If you know the proceeding case number(s) -

If you know the trade mark number(s) –

You can search by your client reference number for the proceeding case –

You can search by the case status. This will enable you to find all proceedings of each type, by current status –

You can also search for the cases you are involved in which have proceedings against them by using the My Case Portfolio functionality, once you are logged into our system.
