6.2 Conflicting Class Table

The conflicting class search list is a list of classes which are associated as they are most likely to contain goods or services that are similar or closely related. It should be used as a guide only.

Searches for conflicting marks are usually refined by restricting the searches to the associated classes of the conflicting class search list.

The list conflicting classes is where it is likely that similar or closely related goods or services will be found. The current conflicting class search list can be found in Annexure 1 to this part of the guidelines.

Although this list is a useful tool in refining searches there are circumstances where similar or closely relation goods and services are found outside these crossed classes.

The tests for determining whether the goods/services are in question are similar or closely related are detailed in 6. Similarity of the goods or services.
