5. Application for alteration of a licensee
Up one levelSection 86 of the Act states that the owner of a trade mark may apply to alter the registration of a licensee. An application for the alteration of the registration of a licensee must be in writing and signed by the owner of the trade mark.28
The application must contain the following information:29
- The licensee’s name;
- If the licensee has an agent, the agent’s name;
- The trade mark for which the licensee is registered;
- The trade mark application or registration number;
- The goods and services for which the license is to be cancelled;
- The goods and services for which the license is to continue;
- Any proposed alteration of the license;
- A statement that the owner has notified the licensee of the application.
