3.5.2 Use and suspension

A trade mark (other than a defensive trade mark) that was registered under the Trade Marks Act 1953 more than five years before the commencement of the Trade Marks Act 2002 cannot be revoked under section 66(1)(b) of the Trade Marks Act 2002 if use was suspended before the commencement of the Trade Marks Act 2002, until use has been suspended for an uninterrupted period of more than five years.24
