Maintain a trade mark
Once you have filed your trade mark there are a number of things you must do maintain it is your application or registration. It is your responsibility to meet deadlines. You may also wish to make limited changes in response to an examination report from IPONZ.
All requests can be submitted online through our Maintain a Trade Mark or Renew a Trade Mark service.
Renew a trade mark
A trade mark registration lasts for 10 years. To maintain the registration you must renew the trade mark by the due date. The fee for a renewal is (NZD $350 (GST exclusive). If the mark is not renewed by the due date it will expire. A trade mark can be renewed up to 12 months before the due date.

Change ownership
Where ownership of a trade mark changes, the owner or applicant must apply to the Commissioner of patents, trade marks and designs, to register ownership (title) of that mark.

Change an address
When an address for service, business or residential address, or, a communication address has changed a notice of change of address must be filed with the Commissioner of patents, trade marks and designs. Note – to own a trade mark you must have an address in New Zealand.

Request an amendment, change goods or services, or, division of an application
After you have applied for a trade mark and before your mark is registered, you may request to make limited amendments to a trade mark application in response to an examination report, or, divide your trade mark application.

Request to merge trade marks
You can apply to merge two or more trade mark applications or registrations into one. There is no charge for the service. Read more...
Restore a trade mark
A trade mark may be restored up to one year after the registration expires. During this period the mark will show on the Register as “Expired but restorable”. You can restore a mark through our online renewal service. The only fee charged for this service is the outstanding renewal fee (NZD $350 (GST exclusive). The restoration itself is free.

You may request to withdraw you application for a trade mark. There is no charge for the service. Read more...
Abeyance
Where an application is awaiting the outcome of opposition proceedings for a prior application, or cancellation/revocation/invalidity proceedings in respect of a prior registration, the applicant must notify the Commissioner of patents, trade marks and designs before the expiry of the deadline set in the Compliance Report.
Upon verification of the facts, the Commissioner will place the application in abeyance pending the outcome of the proceedings.

Continued Processing
You may request continued processing on an abandoned application and at the same time upload a response to your compliance report for consideration. You have up to two months after the deadline for doing so has passes and you may do this only once per application.
